China NMPA Legal Agent Explained: Roles, Responsibilities, and Legal Requirements

Expanding into the Chinese market offers significant opportunities for medical device and IVD manufacturers. However, before your products can be registered with the National Medical Products Administration (NMPA), Chinese regulations require foreign manufacturers to appoint a locally established legal entity as China NMPA Legal Agent. The legal agent serves as your official representative in China and acts as the primary point of contact with the NMPA and supports your ongoing post market obligations after product registration. Without a designated China authorized representative, medical devices and IVDs cannot be legally registered for sale in China.

Depending on the regulation or guidance document, this China Legal Agent may also be referred to as the China Authorized Representative, Regulatory Representative or Domestic Responsible Person.

Responsibilities of a China NMPA Legal Agent

  • Liaison with the NMPA
    The China Legal Agent serves as the official communication channel between the foreign manufacturer and the NMPA. The Legal Agent receives official regulatory correspondence, responds to requests from the NMPA, and facilitates timely communication throughout the entire product lifecycle. This includes supporting interactions during the registration process, responding to requests for additional information, and maintaining communication with the authorities after market approval.
  • Registration
    The China Legal Agent supports manufacturers throughout the NMPA medical device registration process by coordinating regulatory activities. The Legal Agent may monitor the progress of the application, and assist in addressing regulatory questions or requests for supplementary information. This helps streamline the registration process and reduces unnecessary delays. The China Legal Agent also supports the manufacturer in ensuring documentation meets applicable regulatory requirements, including Chinese language and labelling requirements. The agent verifies that product labels, instructions for use (IFUs), and other regulatory documents are suitable for submission.
  • Quality Management System
    The China Legal Agent shall assist manufacturers to set up suitable QMS for products and maintain it effective operation. Most of the manufacturers may also established its own quality system under ISO13485 standard, and they also need to conform to China GMP requirements by identify the local regulations, conducting the gap assessment and mitigating the differences.
  • Regulatory Compliance and Post-Market Surveillance
    The China Legal Agent plays an important role in supporting regulatory compliance both before and after product approval. During the pre-market phase, the Legal Agent facilitates communication with the NMPA and helps ensure that regulatory requirements are addressed throughout the registration process. After the product has been approved, the Legal Agent continues to act as the manufacturer's official local contact, supporting ongoing regulatory obligations such as post-market surveillance, assisting to formulate post market research and risk control plan, monitoring adverse events reporting and evaluation, product changes, establishing traceability and recalls where applicable, and other post-market activities required by the NMPA. The China Legal Agent also needs to ensure these responsibilities are fully implemented.

Although the above-mentioned responsibilities of the China Agent align with the regulatory requirements, the manufacturer remains responsible ultimately for products’ effectiveness and safety.

Changing Your China NMPA Legal Agent: What You Need to Know

In practice, a foreign manufacturer may work with multiple service providers in China, but for each individual medical device registration certificate, only one Legal Agent can be officially appointed with the NMPA.

If you decide to change your China Legal Agent, the process generally involves updating the registration information with the NMPA. While the exact requirements can vary depending on the product type and the registration status, the process typically consists of a few administrative steps. Keep in mind that it can become complex if...:

  • The previous Legal Agent is also acting as the registration owner and hold back all the technical documentation
  • There are ongoing registration applications, change or renewal activities;
  • There are unresolved post-market issues, such as recalls or adverse event investigations.

For this reason, manufacturers are advised to clearly define ownership of technical documentation, regulatory files, and transition obligations in their agreement with the Legal Agent before appointing one.
